Terms & Conditions

1. Definitions
In these Terms and Conditions, the following words carry the meanings given below:
- "Agreement" means these Terms and Conditions together with any project scope document agreed in writing.
- "We / Us / Our" refers to Bestari Systems, registered at Jalan Dato Onn 45, 80000 Johor Bahru, Johor, Malaysia.
- "You / Client" refers to the individual or business engaging our services.
- "Service" refers to any of the AI integration services we provide, as described on our website or in a project scope document.
- "Project" refers to a single service engagement with a defined scope and price.
2. Acceptance of Terms
By engaging our services — whether by submitting an enquiry, signing a scope document, or making a payment — you agree to be bound by these Terms and Conditions.
You must be at least 18 years old and have the legal capacity to enter into binding agreements. If you are entering on behalf of a business, you confirm that you have authority to bind that business.
3. Service Description
Bestari Systems provides AI integration services to small business owners, including:
- Polite Reply Helper — a customer reply assistance setup
- Routine Work Support — an AI toolkit for reducing repetitive tasks
- Simple Insights Setup — a data summary and dashboard arrangement
Services are currently delivered in Johor Bahru, Malaysia, with remote delivery available across Malaysia. We do not currently take on engagements outside Malaysia.
4. Client Responsibilities
To allow us to carry out services effectively, you agree to:
- Provide accurate information about your business and data
- Make yourself or a relevant team member available for agreed sessions
- Ensure that data you share with us is not subject to confidentiality obligations that prevent us from working with it
- Not use our services for any unlawful purpose or in a way that could harm third parties
5. Intellectual Property
Any tools, dashboards, documentation, or outputs we produce specifically for your project become yours upon full payment. General frameworks, methodologies, and internal processes we use remain the property of Bestari Systems.
You may not reproduce or resell our documentation or working methods for commercial purposes without written consent.
6. Payment Terms
All prices are quoted and invoiced in Malaysian Ringgit (RM). Current project prices are:
- Polite Reply Helper — RM 575
- Routine Work Support — RM 960
- Simple Insights Setup — RM 1,350
Payment is due within 14 days of the invoice date. We accept bank transfer (FPX) and online payment via agreed methods. We do not store payment card details.
Refund policy: If a project is cancelled before work begins, a full refund will be issued. If cancelled mid-project, we will charge for work completed to that point on a pro-rata basis and refund the remainder. We do not offer refunds after project handover.
7. Service Delivery
Each project is delivered according to a scope agreed in advance. Timelines are indicative and may extend if you need more time at any stage — we adjust without penalty. If we require something from you (data, feedback, a session booking) and it is delayed beyond 4 weeks, we reserve the right to pause or close the project.
Any changes to the agreed scope are discussed and agreed in writing before additional work proceeds. There are no hidden charges.
8. Disclaimers
Our services are provided to help you work more efficiently with AI tools. We do not promise specific commercial outcomes or revenue increases as a result of our work. Results depend on factors including your business context, how you use the tools, and market conditions beyond our control.
AI tools we recommend are produced by third parties. We select them with care but are not liable for failures, changes, or discontinuation by those third parties.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, our total liability to you in connection with any project shall not exceed the amount paid by you for that project.
We shall not be liable for indirect, consequential, or incidental losses arising from our services, including loss of profit, loss of data, or business interruption.
10. Confidentiality
We treat all business data and information you share with us as confidential. We will not disclose it to third parties except as required to deliver the service or as required by law. Our full data handling approach is described in our Privacy Policy.
11. Termination
Either party may end an engagement by giving 7 days written notice. Payment for work completed to that point will apply as described in Section 6. We may terminate immediately if a client acts in breach of these terms.
12. Dispute Resolution
We prefer to resolve any dispute informally. If you have a concern, contact us at [email protected] and we will respond within 5 working days.
If a dispute cannot be resolved informally, it shall be referred to mediation before litigation. These Terms are governed by the laws of Malaysia. The courts of Johor Bahru, Johor, shall have jurisdiction.
13. General Provisions
- Entire agreement: These Terms, together with any written scope document, constitute the full agreement between us.
- Severability: If any provision is found unenforceable, the remainder of these Terms continues in force.
- No waiver: Failure to enforce any provision does not constitute a waiver of our rights.
- Assignment: You may not assign your rights under this agreement without our prior written consent.
14. Changes to These Terms
We may update these Terms and Conditions from time to time. Changes will be published on this page with an updated date. Continued engagement with our services after a change constitutes acceptance.
